Government, army chief set for legal battle

New Delhi: Indian Army
chief General VK Singh suffered a blow Friday in the Supreme
Court, forcing him to withdraw his plea demanding that his birth
date be treated as May 10, 1951 and not 1950 as the government
maintains.

Judges RM Lodha and HL Gokhale made it clear that his date of
birth would continue to be May 10, 1950 and not May 10, 1951 as
mentioned in his school leaving certificate.

The question before us is not about determination of the actual
date of birth but it concerns recognition of a particular date of
birth by the government in official service records, they ruled,

The court room was packed with over 100 lawyers and others, eager
to follow every bit of an unprecedented legal battle that pitted
the chief of a 1.13-million-strong army against the government.

While holding that Gen Singh had agitated from day one to correct
his birth date, the judges said in all primary documents the date
of birth had been mentioned as May 10, 1951.

These include his application form to the Union Public Service
Commission (UPSC) to join the National Defence Academy, that of
the Indian Military Academy and the army list.

After two and half hours of hearing, the court gave Gen Singhs
counsel a brief adjournment to explore the option of withdrawing
his petition. Left with little elbow room, the army chief did
precisely that.

A defence ministry spokesman said: We are happy the matter has
been resolved amicably and the issue put to rest.

Gen Singhs lawyer Puneet Bali echoed the sentiment, telling
reporters the dragging row has been gracefully resolved.

Bali said Attorney General GE Vahanvatis statement that the
government had not questioned the integrity of the army chief was
enough to satisfy them. The matter has been resolved amicably and
gracefully.

He said the army chief had repeatedly maintained that he was
fighting for his integrity and honour and not to seek an
extension of his tenure that ends May 31 this year.

This was the only battle we were fighting, Bali said. The
honour and integrity have been restored. It is not about tenure.
We are absolutely satisfied.

Once the attorney generals statement has been made, nothing
remains. We are clear in our mind.

We do not want to agitate further… It is the end of the
matter.

The army chief went to the Supreme Court Jan 16 insisting he was
actually born May 10, 1951, not a year earlier as claimed by the
government.

Hearing his petition at the admission stage Friday, the apex court
asked the army chief to honour his letters of 2008 and 2009
accepting 1950 as his birth year.

It noted that the government order recognizing his birth year as
1950 does not suffer from any perversity.

The court said there was no prejudice vis-à-vis Gen Singh and that
the government had full faith in him.

Earlier, the government told the court that it had withdrawn a Dec
30, 2011 order rejecting Gen. Singhs plea to reconcile his birth
date to May 10, 1950 — which prompted him to move the court.

The discrepancy in Gen Singhs age was pointed out by the Military
Secretarys branch in 2006 when he was considered for promotion as
corps commander.

Since then, all his promotions, including as army chief in 2010,
were made on the basis that he was born in 1950.

If 1950 is taken as Gen. Singhs year of birth, he would have to
retire in May. If the year is taken as 1951, he would retire in
March 2013.

Local birding trips to focus on raptors

 A series of field trips staged by the Audubon Societys Black
Canyon chapter will focus on seeking out birds of prey. The trips
take place today, Sunday and Feb. 18.

Taleek Brooks, suspected of videotaping himself abusing kids inside Public School 243 in Brooklyn, took members of an all-boys dance group to see movies like “Avatar” and “How to Train a Dragon” every month.

Education Department spokeswoman Natalie Ravitz insisted the dance group, the Freestylers, was part of an after-school program and not an official club, therefore not subject to city regulations or monitoring.

Novack, a long time ADA committee member, told AIM West Milford that he and committee members Janice Sangle, Kathy Shanahan, and Tim Ligus did a building walk through at the high school with school district representatives in August, 2010.

Novack said he is pleased to hear that the school officials are continuing to work at bringing the buildings – most of them built before ADA regulations were in place – into compliance with the current federal law mandates. During inspections the ADA committee members pointed out situations of non-compliance that needed changing.

The school district has been represented on the committee by Iris Wechling and more recently John Hink.

On recommendation of Interim School Superintendent John Petrelli, the BOE on Jan. 24 unanimously approved an agreement with LAN Associates, Midland Park, for ADA compliance surveys for the district’s eight schools, the administration building and transportation. The price by LAN to do the survey is $6,400.

Entrance doors

Other agenda items for the meeting that were approved on recommendation of Petrelli were a contract to C and M Door Controls Inc., Port Reading, for the replacement of the exterior playground entrance doors at Maple Road School in the amount of $6,950. Also, a contract was given to the firm for $16,200 to replace the main entrance doors at Macopin School.

Well monitoring

There was BOE approval for the Skyline Environmental Group Excavating, West Milford, to continue with toxic soil delineation efforts by installing three additional monitoring wells, collecting groundwater samples and preparation of data summary. Cost for the work is $10,656. This is a continuation of efforts to remove toxic soil found earlier in the transportation department area. In 2002 the BOE confirmed that elevated levels of toxic contaminants were found. When new information is available it will shared at BOE meetings, trustees said.

I think we have our backup plan, last year we ran out about 2 oclock, said co-owner of Ceros Candies, Pam Bishop.

The busiest day for a florist, it takes an immense amount of energy, time and planning, is the 12th, 13th and even the day of the 14th for those last minute people, said McKnight.

McKnight has owned her florist for 31 years and throughout that time, she has learned to prepare for her share of last minute gifters.

From about four oclock on you will see lines of men at the counter waiting, said McKnight.

She says her florist will never run out of flowers on Valentines Day, but ordering ahead of time guarantees you a broader selection.

You get the cream of the crop, the top of the products, you have the widest selection and you have some time they can still be delivered, said McKnight.

While red roses are a traditional Valentines Day favorite, she says orange, hot pink and lavender colors are gaining in popularity this year.

As for what has been trending in the candy business, Bishop says dark chocolates.

First they go to it for the health benefits and then they find that they l really like the taste of it, said Bishop.

But the biggest beneficiaries, in the long run, may turn out to be utilities, theme parks, telecom companies and the rest of the states largest businesses.

Forecasters have warned that the cold spell currently gripping Britain could last until the end of the month, with very cold temperatures leading to hard frosts in the coming days.
